1. Status and agreement
Pieced & Kept is currently in development and is not yet available. The base app is planned as a free download, with an optional one-time Founding Edition unlock offered as a non-consumable in-app purchase. These terms are prepared to apply when the product is released by Everfixed Studios LLC. If acquired through Apple's App Store, Apple's applicable standard or custom end-user license agreement and usage rules also apply. Store terms and rights that cannot legally be waived remain in effect.
2. Limited license
Pieced & Kept is licensed, not sold, whether you use the free base app or purchase the Founding Edition unlock. Subject to these terms and the applicable store rules, Everfixed Studios grants you a limited, nonexclusive, nontransferable, revocable license to install and use the app on devices associated with your lawful store entitlement. Everfixed Studios retains all rights not expressly granted.
3. No sharing, resale, or circumvention
You may not copy, publish, upload, redistribute, sell, rent, lease, sublicense, or make the app or extracted program files available to another person. You may not bypass or defeat store licensing, security, signing, purchase, or update controls. You may not reverse engineer, decompile, or disassemble the software except only to the extent applicable law expressly permits despite this restriction.
4. Your content remains yours
You retain ownership of photographs, stories, names, records, and other content you add. You are responsible for having the right to use, print, export, and share that material, including information about collaborators, recipients, or other people.
5. Local archive and backup responsibility
Pieced & Kept is designed to store its working archive in the app's private local storage. Everfixed Studios does not hold a recovery copy. Device failure, loss, damage, operating-system action, app deletion, storage cleanup, or an incorrect restore can make local records unavailable. Export current backup files regularly and keep at least one usable copy somewhere separate from the device.
6. Restore and deletion precautions
Restoring an archive may replace records already on the device. Export the current archive before restoring another file, deleting the app, erasing or replacing a device, or making any other change that could remove local data. Confirm that an exported file exists and can be selected before treating it as a dependable backup.
7. Exports, labels, and printed results
Exported archives may contain private text and photographs and should be protected accordingly. Label, passport, report, and keepsake results can vary by printer, paper or fabric material, page scaling, color management, application, and device. Review content, spelling, measurements, calibration marks, layout, and color before relying on or permanently attaching a printed result.
8. Uses Pieced & Kept is not designed for
Pieced & Kept is a personal documentation and keepsake tool, not a guaranteed archival-preservation, legal-provenance, appraisal, insurance, tax, estate-planning, emergency, or safety-critical system. Keep authoritative records and irreplaceable source photographs outside the app.
9. Privacy
The product is designed without an Everfixed account or developer-operated cloud archive. Files leave the app only when you use system features or third-party services to save, print, back up, or share them. Current details are provided in the Everfixed Studios privacy policy and will be finalized in a dedicated product policy before release.
10. Updates, support, and store transactions
Everfixed Studios may provide updates that correct defects, preserve compatibility, improve security, or change features. Support and compatibility cannot be guaranteed indefinitely for every device or operating-system version. Apple controls App Store delivery, account entitlements, installation, updates, billing, purchase restoration, family sharing, and App Store refund processes. A lawful non-consumable Founding Edition purchase is intended to be restorable through Apple's Store mechanisms on eligible devices using the purchasing Apple ID.
11. Disclaimer of warranties
To the maximum extent permitted by applicable law, Pieced & Kept is provided as is, as available, and with all faults. Everfixed Studios disclaims implied warranties and conditions, including merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and noninfringement. This section does not limit any warranty or consumer right that applicable law does not allow to be excluded.
12. Limitation of liability
To the maximum extent permitted by applicable law, Everfixed Studios will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss or corruption of archives, photographs, or other data; lost profits, revenue, business, opportunity, or goodwill; or the cost of substitute products or services. Where a monetary limit is legally permitted and the applicable store license does not require a different limit, Everfixed Studios' total aggregate liability will not exceed the amount you paid for Pieced & Kept. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.
13. Termination
Your license ends automatically if you materially violate these terms. When it ends, you must stop using the app and remove any unauthorized copies in your possession or control. Sections concerning ownership, restrictions, disclaimers, liability, and disputes survive termination where legally permitted.
14. Governing law and general terms
These terms are governed by Minnesota law, without regard to conflict-of-law rules, except where the law where you live gives you nonwaivable rights or requires another law or forum. If one provision is unenforceable, the remaining provisions continue to apply. Everfixed Studios may revise these terms before release or for future versions; changes do not retroactively remove rights already granted by law.
